Terms and Conditions

The terms on which you may use the Merpati Healthservices Berhad website, the Merpati member application, and the digital membership card.

1. This agreement

These terms are an agreement between you and Merpati Healthservices Berhad ("MHSB", "we", "us"). They apply when you visit https://www.mhsberhad.com, when you register for or hold an MHSB membership, and when you use the Merpati application on any device.

By registering or by continuing to use the platform you accept these terms. If you do not accept them, do not register and do not use the platform.

How we handle your personal data is set out separately in our Privacy Notice, which forms part of your relationship with us but is a distinct document with its own consent.

2. Who may register

Membership is open to those MHSB admits under its membership criteria — principally doctors, dentists and other healthcare professionals, clinic owners and clinic representatives. You must be at least 18 years old and able to enter into a binding agreement.

You must give accurate, current and complete information when you register, and keep it up to date afterwards. Registering with someone else's identity, or with details you know to be false, is a breach of these terms.

3. Applications, approval and membership numbers

Registering creates an application, not a membership. MHSB reviews each application, may ask for supporting documents — an Annual Practising Certificate, Borang B or Borang F, a signed memorandum of understanding — and may approve or decline it.

A membership number is allocated on approval, and remains MHSB's to allocate, reassign or withdraw. Where an application is declined, the reason is recorded and you may apply again once the reason has been addressed.

4. Your account and your card

Sign-in is by a one-time code sent to your registered email address. Keep your email account secure: anyone who can read your email can sign in as you. Tell us immediately if you believe your account has been used without your authority.

Your digital membership card is personal to you. Do not lend it, share a screenshot of it for someone else to present, or let another person use your account. Cards are verified through short-lived rotating codes, and a card presented by anyone other than its holder may be refused and reported to us.

5. Acceptable use

When using the platform you must not:

  • Impersonate another person, or misrepresent your professional qualifications, registration or affiliation.
  • Upload a document you know to be forged, altered or not your own.
  • Attempt to gain access to accounts, data or systems you are not authorised to reach, or probe, scan or test the security of the platform without our written permission.
  • Extract, scrape or republish the clinic directory or member data in bulk.
  • Interfere with the operation of the platform, or use it to distribute malware or unlawful content.
  • Use the platform for any purpose that is unlawful, or that breaches the rules of your professional body.

6. Clinics, companies and memoranda of understanding

Where you register a clinic or company, or sign a memorandum of understanding through the platform, you confirm that you are authorised to do so on that entity's behalf and that the details you provide are correct.

An MOU signed through the platform, and any countersignature by MHSB, has the same effect as one signed on paper. The MOU's own terms govern the relationship between MHSB and that clinic or company; where they conflict with these terms, the MOU prevails on the subject it covers.

7. Fees

Any membership fee, subscription or charge is as notified by MHSB from time to time. Fees are payable in the manner notified, and are not refundable except where MHSB says so or the law requires it.

Benefits, discounts and rates offered by clinics or partners in the network are set by those clinics and partners. They may change, and MHSB does not guarantee that any particular benefit will remain available.

8. No medical advice, and no guarantee of treatment

The platform is a membership and directory service. It does not provide medical advice, diagnosis or treatment, and nothing on it should be relied on as such.

Clinics and practitioners listed in the directory are independent. MHSB does not provide clinical services, does not supervise clinical care, and is not responsible for the treatment any clinic or practitioner provides. Listing is not an endorsement of clinical competence.

9. Availability and changes to the platform

We aim to keep the platform available, but we do not promise that it will be uninterrupted or error-free. We may suspend it for maintenance, and we may add, change or withdraw features.

We may change these terms. Where a change is material we will bring it to your attention; continuing to use the platform after that means you accept the change.

10. Suspension and termination

We may suspend or terminate a membership or an account where these terms are breached, where a document or declaration turns out to be false, where a professional registration lapses, or where the law requires it. Where it is reasonable to do so, we will tell you why and give you an opportunity to put it right.

You may stop using the platform at any time, and you may delete your account from within the app. Deleting an account does not by itself end an MOU, and it does not remove records we are required to keep — see the Privacy Notice for what is retained and for how long.

11. Intellectual property

The platform, its software, design, text, logos and marks are owned by MHSB or its licensors. You may use them only as the platform intends. You keep ownership of the documents and content you upload, and grant MHSB the right to store and use them for the purposes described in the Privacy Notice.

12. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, MHSB is not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data, arising from your use of the platform or from any clinical service provided by a clinic or practitioner in the network.

13. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute arising from them.
